Maintenance

Before a court may award maintenance, a division of marital property must be made except when dealing with issues of temporary maintenance as discussed above. A party seeking maintenance must establish two elements in order to be awarded maintenance: (1) that the party seeking maintenance lacks sufficient property to meet his/her reasonable needs, and (2) that the party is not capable of supporting themselves in their employment or care for a child whose health or circumstances prevent them from working outside the home.
